Preventing Problems,
Resolving Disputes.™

Our priority is to prevent problems and to keep our clients out of court and away from disputes, claims and agency investigations.  Obviously, that is not always possible.  In that case, we resolve disputes.  We have extensive experience in trying all kinds of employment lawsuits in state and federal courts, before juries and arbitrators.  We have extensive familiarity and success with some of the State’s most challenging venues.  We also have successfully handled appeals through the Texas courts of appeal, to the Federal Fifth Circuit Court of Appeals and even to the U.S. Supreme Court.  

Extensive litigation experience.

We have successfully tried a wide variety of cases and handled hundreds of lawsuits and claims for publicly traded corporations, small to mid-size businesses, executives, professionals and individuals, involving at least the following types of matters:

Discrimination
(Based on age, disability, sex, national origin, race, religion, etc.)

Harassment
(sex, race, workers’ comp., disability, age, etc.)

Retaliation
(for claiming workers’ comp, for seeking ERISA benefits, for seeking FLSA relief, for opposing discrimination or filing a charge, for using FMLA leave, for reporting violations of law, etc.)

Wrongful Discharge (in breach of contract, for refusing to commit an illegal act, etc.)

Whistleblowing (under state and federal statutes)

Breach of contract (for commissions, bonus plans and compensation contracts, etc.)

Noncompete injunctions against violations of agreements (e.g., relating to agreements for confidentiality, nonsolicitation, covenants against competition and nondisclosure of trade secrets and proprietary information)

Fair Labor Standards Act violations (overtime, minimum wage, improper exemptions, failure to pay, etc.)

Alternative Dispute Resolution.
When appropriate, we negotiate favorable settlements on behalf of our clients and advocate for compromise resolutions in alternative dispute resolution forums such as mediation and arbitration.
